October 2023 – Response from the Brazilian Institute for Consumer Protection (Idec) to the extension of the deadline by more than a year for the implementation of the magnifying glass label and the Collegiate Board Resolution (RDC) No. 819/2023 of the National Health Surveillance Agency (Anvisa), which regulates the nutritional labeling of packaged foods.

Idec denounces that Anvisa is prioritizing the industry by granting more time, despite having had sufficient time to adapt labels, to the detriment of consumers’ right to be informed. Additionally, the extension makes it impossible to verify whether packaging was already in stock before the deadline. The resolution extending the deadline was published without prior notice and without a public discussion or debate.

Idec has taken actions such as requesting explanations from the Ministry of Public Health, seeking documentation to understand the reasons behind the decision, and considering legal action against Anvisa if necessary. Idec highlights the importance of clear and transparent food product information for consumers and views the approval of the new magnifying glass nutritional labeling model as a step forward for Brazil. It emphasizes the need for the industry to show greater respect for consumers and comply with regulations.

Additionally, the statement references a study conducted by Brazilian researchers, which found that the consumption of ultra-processed foods in Brazil contributed to a significant number of premature deaths in 2019.
